Chaperone Policy
The practice will always respect your privacy, dignity and your religious and cultural beliefs particularly when intimate examinations are indicated – these will only be carried out with your express agreement and you will be offered a chaperone to attend the examination if you so wish.
All patients are entitled to be accompanied by a friend or family member.
You may also request a chaperone when making the appointment or on arrival at the surgery (please let the receptionist know) or at any time during the consultation.
The practice is committed to providing a safe, comfortable environment where patients and staff can be confident that best practice is being followed at all times.

Complaints, Suggestions & Feedback
Suggestions are always welcome…
Our practice welcomes feedback from its patients as it is only by listening to the users of our service that we can make adjustments, improvements and know what has gone well or not so well.
If you are unhappy with anything that has happened to you in the practice or have any suggestions about how this might be put right, the practice operates a complaints procedure as outlined by the NHS.
Making a Complaint
If you need to complain…
We hope that most problems can be resolved easily and quickly, often at the time they arise and with the person concerned. If you still wish to make a complaint, please inform a member of the practice as soon as possible. At times it may not be possible to raise a complaint immediately or you may need some time before you are able to raise your concerns. It is important to highlight that it may not be possible to resolve a concern depending on how much time has lapsed. NHS complaints procedures recommend a complaint is raised within 12 months of the concern taking place or within 12 months of becoming aware a complaint should be raised.

What we will do
We will acknowledge your complaint within 3 working days and aim to provide a response within 30 working days of the date you raised it with us. At times more complex concerns or complaints may take longer to resolve however every effort to keep you informed will be made.
Complaining on behalf of someone else
Please note that we keep strictly to medical confidentiality. If you are complaining on behalf of someone else, we much ensure you have their permission to do so. A note signed by the person concerned will be needed, unless they are incapable (because of illness) of providing this.

If you are not happy with our resolution we would ask you to in the first instances to make us aware of your dissatisfaction, if we still are unable to come to a resolution to your satisfaction you do hold the right to contact the Parliamentary and Health Service Ombudsman. If you are not satisfied with how the practice responds to your complaint
If you are ultimately not happy with how we have dealt with your complaint, and would like to take the matter further, you can contact the Parliamentary and Health Service Ombudsman, who make final decisions on unresolved complaints about the NHS in England.

Confidentiality
You can rest assured that anything you discuss with any member of the surgery staff, whether doctor, nurse or receptionist, will remain completely confidential.
If you are under 16, and you tell us that you would like your medical records to be confidential, no information will be given to anyone without your permission – this includes parents, other relatives, care workers or teachers. The only circumstances in which the practice would consider passing on information without your permission would be to protect either you or someone else from serious harm. In this situation we would always try to discuss this with you before any information is released.
Even if you are under 16, nothing will be said to anyone, including parents, other family members, care workers or teachers, without your permission. Data Protection
In order to provide the right level of care, we are required to hold personal information about you on our computer systems and in paper records to help us to look after your health needs, and your doctor is responsible for their accuracy and safe-keeping. Please help to keep your record up to date by informing us of any changes to your circumstances.
Confidentiality and Personal Information
Doctors and staff in the practice have access to your medical records to enable them to do their jobs. From time to time information may be shared with others involved in your care if that is necessary. Anyone with access to your record is has received training about confidentiality and data protection and is governed by both legal and contractual duty to keep your details private.
All information about you is held securely and appropriate safeguards are in place to prevent accidental data loss.
In some circumstances we may be required by law to release your details to statutory or other official bodies, for example if a court order is presented, or in the case of public health issues. In other circumstance you may be required to give written consent before information is released – such as for medical reports for insurance, solicitors etc.
To ensure your privacy, we will not disclose information over the telephone or fax unless we are sure that we are talking to you. Information will not be disclosed to family, friends or spouses unless we have prior written consent, and we do not leave messages with others or on telephone answer machines unless we have been given permission to do so.
You have a right to see your medical records if you wish. Please ask at reception if you would like to apply to do this.
Disabled Access
We make every effort to make all our surgeries accessible for disabled patients. At each site there is access via a ramp to the main door and we have a wheelchair available for use in every surgery.
St Marychurch surgery – consultations upstairs
Our surgery at St Marychurch has some upstairs consultation rooms. There is a stair lift at the surgery to give disabled patients access to the first floor consultation rooms.
If you do not want to use the stair lift, then please let the reception team know when you are booking an appointment. We can always make arrangments for you to be seen downstairs.
Hearing Difficulties
If you experience hearing difficulties when being called in to see the doctor or nurse, please do let us know so that we can set up an alert on your medical records and personally collect you from the waiting room. Alternatively, we do have the facility of a portable induction loop. If you would like to use this, please ask at reception for assistance.
Accessible Information Standard
The Accessible Information Standard is a law which aims to make sure people with a disability or sensory loss are given information they can understand, and the communication support they need. The practice complies with the Accessible Information Standard.
Please let a member of the practice team know if you require communication in a specific format (for example, large font text or Braille).
GP Earnings
2022/2023 Publication of GP Net Earnings
All GP practices are required to declare the mean earnings (e.g. average pay) for GPs working to deliver NHS services to patients at each practice.
The average earnings for GPs working at Brunel Medical Practice in the last financial year was £115,416 before tax and National Insurance. This is for 1 full-time GP partner, 2 part-time GP partners, 6 salaried GPs and 3 locum GPs who worked in the practice for more than six months.
IT Policy
This practice is committed to preserving, as far as is practical, the security of data used by our information systems. This means that we will take all reasonable actions to;
Maintain the Confidentiality of all data within the practice by:
- Ensuring that only authorised persons can gain access to our systems
- Not disclosing information to anyone who has no right to see it
Maintain the integrity of all data within the practice by:
- Taking care over input
- Ensuring that all changes are reported and monitored
- Checking that the correct record is on the screen before viewing or updating
- Reporting all apparent errors and ensuring that they are resolved
Maintain the availability of all data by:
- Ensuring that all equipment is protected from intruders
- Ensuring that backups are taken at regular, predetermined intervals
- Ensuring that contingency is provided for possible failure or equipment theft and that any such contingency plans are tested and kept up to date

Named Accountable GP
All Brunel patients, including children, have a Named Accountable GP who takes overall responsibility for their care.
The Named Accountable GP may sometimes be called Registered GP.
Please ask at reception if you wish to know which Doctor is your Named Accountable GP.
Although you have a Named Accountable GP, you are free to consult with any of our GPs, or any member of the clinical team. Just ask at reception.
If you tell us that you want to change your Named Accountable GP, we will make every reasonable effort to do so.
Personal Data
The following IT systems are in use at the practice:
- Appointment booking
- Referral management (using NHS numbers in referrals – and not names)
- Internal appointment booking and cancellation
- Online appointment booking and cancellation
- Online repeat prescription requests
- Summary Care Record (uploading details of your current medication and allergies to the national “spine” so that these are available for doctors involved in your care away from the practice)
- Electronic transfer of records from practice to practice when you register (GP 2 GP)

This privacy notice describes the data, the practice holds about you, why we hold it, where and how we store it, how long for and how we protect it. It also tells you about your rights under the Data Protection Legislation and how the law protects you.

Brunel Medical Practice is a Data Controller for the data we hold about you. We hold your data in order to provide you with health and social care.
What is personal data and what data do we use?
Your personal data is any information that can be connected to you personally. If you can be identified from the data, it is personal data. The types of personal data we use and hold about you are:
- Details about you: your name, address, contact number, email address, date of birth, gender and NHS number. We may also hold information about your emergency contact, next of kin and carer.
- Details about your medical care: medical diagnosis, record of treatment received, referrals, history of prescribed medication, results of investigations such as X-rays etc.
- Information provided by you: this includes correspondence relating to feedback, concerns and complaints about the service you have received.
- Relevant information from other healthcare professionals, relatives or those who care for you.
- All telephone calls to and from the Practice are recorded for training and monitoring purposes.
We may also hold the following information about you:
- Religion or other beliefs of a similar nature,
- Family, lifestyle and/or social circumstances,
- Employment details,
- Financial details.
When we collect your mobile number we use it to text you to remind you of appointments notifying you about temporary changes to our opening hours (for example for staff training) and to alert you to important updates such as how to book vaccination appointments. If you no longer wish to receive communication this way, please let a member of staff know who will be able to update your preferences.
When we collect your email address, we use it to contact you regarding online consultations and to send documents such as sick notes with your permission. If you no longer wish to receive communication this way, please let a member of staff know who will be able to update your preferences.
Why do we process your data and what legal basis do we have to process your data?
In order to process your personal data or share your personal data outside of the practice, we need a legal basis to do so. If we process or share special category data, such as health data, we will need an additional legal basis to do so.
We rely upon Article 6(1)(e) (public interest task) and Article 9(2)(h) (health and social care) for most of our processing and sharing, in particular to:
- Provide you with health and social care,
- Share data from, or allow access to, your GP record, for healthcare professionals involved in providing you with health and social care,
- Receive data from or access your data on other NHS organisation clinician systems,
- Work effectively with other organisations and healthcare professionals who are involved in your care,
- Ensure that your treatment and advice, and the treatment of others is safe and effective,
- Participate in National Screening Programmes,
- Use a computer program to identify patients who might be at risk from certain diseases or unplanned admissions to Hospitals,
- Help NHS Digital and the practice to conduct clinical audits to ensure you are being provided with safe, high quality care,
- Support medical research when the law allows us to do so,
- Supply data to help plan and manage services and prevent infectious diseases from spreading.
We rely upon Article 6(1)(d) (vital interest) and Article 9(2)(c) (vital interests) to share information about you with another healthcare professional in a medical emergency.
We rely upon Article 6(1)(e) (public interest task) and Article 9(2)(g) (substantial public interest) to support safeguarding for patients who, for instance, may be particularly vulnerable to protect them from harm or other forms of abuse.
We rely upon Article 6(1)(c) (legal obligation) and Article 9(2)(h) to share your information for mandatory disclosures of information (such as NHS Digital, CQC and Public Health England).
We rely upon Article 6(1)(c) (legal obligation) and Article 9(2)(f) (legal claims) to help us investigate legal claims and if a court of law orders us to do so.
We rely upon Article 6(1)(a) (consent) and Article 9(2)(a) (explicit consent), in order to:
- Help the practice investigate any feedback, including patient surveys, complaints or concerns you may have about contact with the practice,
- Help manage how we provide you with services from the practice, for example, when you nominate individuals to contact the practice on your behalf,
- Share your information with third parties, for example, insurance companies and medical research organisations.
We also use anonymised data to plan and improve health care services. Specifically, we use it to:
- Review the care being provided to make sure it is of the highest standard,
- Check the quality and efficiency of the services we provide,
- Prepare performance reports on the services we provide.
Healthcare staff will respect and comply with their obligations under the common law duty of confidence.
How do we collect your data?
The practice collects data that you provide when you:
- Receive treatment or care from the practice,
- Contact the practice by telephone (telephone calls received and made by the practice may be recorded), online or in person,
- Complete a form electronically or in paper,
- Contact the practice via a Social Network (for example if you communicate with the practice through Twitter or Facebook)
- Visit the practice’s website (If cookies are enabled).
We receive information about you from other providers to ensure that we provide you with effective and comprehensive treatment. These providers may include:
- The GP Practices within the Torquay Primary Care Network
- Other GP Practices
- NHS Trusts/Foundation Trusts
- NHS Commissioning Support Units (CSUs)
- Community Services (District Nurses, Rehabilitation Services and out of hours services)
- Ambulance or emergency services

We also use Patient Triage which is an online tool that allows you to get advice and treatment, request sick notes and results or self-help.
Patient Triage is provided by a third-party organisation and by using eConsult, you are submitting your information to them. This information is then provided to the practice to be reviewed.

Who do we share your data with?
In order to deliver and coordinate your health and social care, we may sometimes share information with other organisations. We will only ever share information about you if other agencies involved in your care have a genuine need for it. Anyone who receives information from the practice is under a legal duty to keep it confidential and secure.
Please be aware that there may be certain circumstances, such as assisting the police with the investigation of a serious crime, where it may be necessary for the practice to share your personal information with external agencies without your knowledge or consent.
We may share information with the following organisations:

In addition to sharing data with the above services, the practice will also use carefully selected third party service providers that process data on behalf of the practice. When we use a third party service provider, we will always have an appropriate agreement in place to ensure that they keep the data secure, that they do not use or share information other than in accordance with our instructions and that they are operating responsibly to ensure the protection of your data. Examples of functions that may be carried out by third parties includes:
- Organisations that provide IT services & support, including our core clinical systems; systems which manage patient facing services (such as our website and service accessible through the same); data hosting service providers; systems which facilitate video consultation, appointment bookings or electronic prescription services; document management services etc.
- Organisations who are delivering services on behalf of the practice (for example conducting Medicines Management Reviews to ensure that you receive the most appropriate, up to date and cost-effective treatments or supporting practices in offering choices of providers and appointments to patients who are being referred via the NHS E-Referral system).
- Delivery services (for example if we were to arrange for delivery of any medicines to you).
- Payment providers (if for example you were paying for a prescription or a service such as travel vaccinations).

Where do we store your data?
We use a number of IT systems and tools to store and process your data, on behalf of the practice. Examples of tools we use include our Core Clinical System EMIS, NHSmail, Microsoft 365, eConsult, PhotoSaf and AccuRx.. Telephone call recording are stored through our telephony provider Babblevoice.

GPConnect/Interoperability/Enhanced Data Sharing Module:
We share your record using GP Connect/Interoperability/Enhanced Data Sharing Module to make sure that, whether you are visiting the practice, attending hospital, or being seen in the community or at home by a care professional, everyone knows the care you need and how you want to be treated. Your electronic health record is available to the practices in Torquay Primary Care Network and other local providers, Baywide PCN and Paignton & Brixham PCN who are involved in your care, providing Enhanced Access appointments at weekends and COPVID-19 Vaccination appointments. This includes the sharing of, personal contact details, diagnosis, medications, allergies and test results. Your records will be treated with the strictest confidence and can only be viewed if you use their service.
Please note that if you have previously dissented (opted-out) to sharing your records, this decision will be upheld, and your record will only be accessed by the practice. Should you wish to opt-out of, please speak to the Practice Manager who will be able to update your personal preferences. Please note that by opting out of this sharing, other health professionals may not be able to see important medical information, which may impact on the care you receive.
Summary Care Record (SCR)
NHS England have implemented the SCR which contains information about you; including your name, address, data of birth, NHS number, medication you are taking and any bad reactions to medication that you have had in the past. This information is automatically extracted from your records and uploaded onto a central system.
Many patients who are seen outside of their GP Practice are understandably not able to provide a full account of their care or may not be in a position to do so. The SCR means patients do not have to repeat their medical history at every care setting and the healthcare professional they are seeing is able to access their SCR. The SCR can only be viewed within the NHS on NHS smartcard-controlled screens or by organisations, such as pharmacies, contracted to the NHS.
As well as this basic record, additional information can be added to include further information. However, any additional data will only be uploaded of you specifically request it and with your consent. National Screening Programmes
The NHS provides national screening programmes so that certain diseases can be detected at early stages. These screening programmes include bowel cancer, breast cancer, cervical cancer, aortic aneurysms and a diabetic eye screening service. Risk Stratification
Your medical records will be searched by a computer program so that we can identify patients who might be at high risk from certain diseases such as heart disease or unplanned admissions to hospital. This means we can offer patients additional care or support as early as possible.
This process will involve linking information from your GP record with information from other health or social care services you have used. Population Health Analytics
As well as using your data to support the delivery of care to you, your data may be used to help improve the way health and social care is delivered to patients and service users throughout Devon using Population Health Management methods. We will only use a pseudonymised extract (ie. not identifiable information) which will be sent securely to NHS Devon CCG and in partnership with Optum. Optum have been appointed to provide technical assistance to NHS Devon CCG and use the data to support the Devon Integrated Care System to improve short term and medium-term health outcomes for local populations. Please note that at no time will patient identifiable data be used in the delivery of this programme. Patients who have a Type 1 opt-out will be excluded from this programme and will not have their data extracted for this purpose.

Research
We are a research practice and work with the NHR, National Institute for Health Research to deliver research studies and trials. Employees of the practices will access your information in order to determine whether you are suitable to be invited to participate in a study. We will only share your information with the research providers with your explicit consent.
Clinical Practice Research Datalink (CPRD) [Delete if not applicable to practice]
This practice contributes to medical research and may send relevant data to CPRD. CPRD collects de-identified patient data from a network of GP practices across the UK. Primary care data is linked to a range of other health related data to provide a longitudinal, representative UK population health dataset. How long do we hold your data?
We only hold your data for as long as necessary and are required to hold your data in line with the NHS Records Management Code of Practice for Health and Social Care 2016 Retention Schedule. Further information can be found online at:
What rights do you have?
You have various rights under the UK GDPR and Data Protection Act 2018:
Right of access:
You have the right to request access to view or request copies of the personal data, we hold about you; this is known as a Subject Access Request (SAR). In order to request access, you should:

Please note that you are entitled to a copy of your data that we hold free of charge; however, we are entitled to charge in certain circumstances where the law permits us to do so. We are also entitled to refuse a request, where the law permits us to do so. If we require a fee or are unable to comply with your request, we will notify you within 1 calendar month of your request.
Right to restrict or object the use of your information:
There are certain circumstances in which you can object from your data being shared. Information regarding your rights to opt-out is detailed below:
Consent:
If the practice is relying on the consent as the basis for processing your data, you have the right to withdraw your consent at any time. Once you have withdrawn your consent, we will stop processing your data for this purpose.
However, this will only apply in circumstances on which we rely on your consent to use your personal data. Please be aware that if you do withdraw your consent, we may not be able to provide certain services to you. If this is the case, we will let you know.
Summary Care Record:
The SCR improves care; however, if you do not want one, you have the right to object to sharing your data or to restrict access to specific elements of your records. This will mean that the information recorded by the practice will not be visible at any other care setting.
If you wish to discuss your options regarding the SCR, please speak to a member of staff at the practice. You can also reinstate your consent at any time by giving your permission to override your previous dissent.
National Screening Programmes:
If you do not wish to receive an invitation to the screening programmes, you can opt out at https://www.gov.uk/government/publications/opting-out-of-the-nhs-population-screening-programmes or speak to the practice.
Type 1 Opt-out:
You have the right to object to your confidential patient data being shared for purposes beyond your direct care by asking the practice to apply a Type 1 opt-out to your medical records. A type 1 opt-out prevents personal data about you, being extracted from your GP record, and uploaded to any other organisations without your explicit consent. If you wish for a Type 1 opt-out to be applied to your record, please contact the Practice.
Please note that the type 1 opt-out will no longer be available after 2020 and therefore you will be unable to object to your data being shared with NHS Digital when it is legally required under the Health and Social Care Act 2012.
National Data Opt-out:
You have the right to object to your data being shared under the national data opt-out model. The national data opt-out model provides an easy way for you to opt-out of sharing data that identifies you being used or shared for medical research purposes and quality checking or audit purposes.

Cancer Registry:
The National Cancer Registration and Analysis Service is run by Public Health England and is responsible for cancer registration in England, to support cancer epidemiology, public health, service monitoring and research.

Right to rectification:
You have the right to have any errors or mistakes corrected within your medical records. This applies to matters of fact, not opinion. If the information is of clinical nature, this will need to be reviewed and investigated by the practice. If you wish to have your records amended, please contact the Practice.
If your personal information changes, such as your contact address or number, you should notify the practice immediately so that we can update the information on our system. We will also ask you from time to time to confirm the information we hold for you, is correct.
Right to erasure:
The practice is not aware of any circumstances in which you will have the right to delete correct data from your medical record, which the practice is legally bound to retain. Although you are free to obtain your own legal advice if you believe there is no lawful purpose for which we hold the data and contact the practice if you hold a different view.

Summary Care Record
ADULTS
Your patient record is held securely and confidentially on the electronic system at your GP practice. If you require treatment in another NHS healthcare setting such as an Emergency Department or Minor Injury Unit, those treating you would be better able to give you appropriate care if some of the information from the GP practice were available to them.
This information can now be shared electronically via: The Summary Care Record, used nationally across England
The information will be used only by authorised health care professionals directly involved in your care. Your permission will be asked before the information is accessed, unless the clinician is unable to ask you and there is a clinical reason for access.
If you would like to opt out, please ask reception for our opt out form.
CHILDREN
A parent or guardian can request to opt out children under 16 but ultimately it is the GP’s decision whether to create the records or not, because of their duty of care to the child. If you are the parent or guardian of a child under 16 and feel that they are able to understand, then you should make this information available to them.

Training & Research
Training
We are a training practice, which makes us instrumental in the development of future healthcare professionals at every level. Working with local universities we host placements for second and fifth year medical students, and student nurses. We also provide registrar training on a six month rotation.
Some student Doctors and Nurses simply observe consultations, while other more senior students may consult with patients either on their own or with a mentor.
If you have an appointment to see a Doctor or a Nurse and a student is scheduled to be present during the consultation, you will always be informed prior to the appointment, and given the opportunity to request to see the clinician alone.
Research
We are proud to say that Brunel Medical Practice is a Research Ready accredited practice. We take part in various studies in conjunction with the NHR (National Institute for Health Research).
Our Research Lead GP is Dr Richard Veale who is supported by Lisa van Kuyk (Research Nurse), Pam Grills (Research Administrator) and Hayley Reed (Health Care Assistant).
The research team are often looking for new recruits for studies and will be posting up-coming studies on the practice’s Facebook page and on Research boards in the surgeries.
Recent studies that our patients have taken part in include studies looking at Chronic Kidney Disease (CKD), Chronic Obstructive Pulmonary Disease (COPD), urinary tract infections and early arthiritis diagnosis.
We will soon be recruiting for new studies which will include coughs and colds in children, COPD , further CKD studies and other interesting areas – watch this space!
Lisa and Dr Veale attended the South West Clinical Research Forum this year, where Lisa was presented with the Outstanding Research Individual Award for her hard work in recruiting patients for studies and her enthusiasm in ensuring new research studies and techniques are embraced by the practice.
Violence Policy
The Practice staff always show due respect and courtesy when dealing with patients and their representatives. We respectfully request that patients and their representatives do the same when dealing with members of the practice team.
The NHS operates a zero tolerance policy with regard to violence and abuse and the practice has the right to remove violent patients from the list with immediate effect in order to safeguard practice staff, patients and other persons.
No form of aggression (whether verbal or physical in nature) will be tolerated. Any instances of such behaviour on the practice premises may result in the perpetrator being reported to the Police and removed from the practice’s list of Registered Patients.
Violence in this context includes actual or threatened physical violence or verbal abuse which leads to fear for a person’s safety. In this situation we will notify the patient in writing of their removal from the list and record in the patient’s medical records the fact of the removal and the circumstances leading to it.
